General provisions

The e-commerce website of Broodjesbrigade BV with registered office at Jules Moretuslei 89, 2610 Wilrijk, VAT BE 0789.483.988, RPR Antwerp, (hereinafter ‘Broodjesbrigade‘) offers its customers the opportunity to purchase products from its online shop online.

These General Terms and Conditions (“Conditions“) apply to every order placed by a visitor to this e-commerce website (“Customer“). When placing an order via the Broodjesbrigade webshop, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions, to the exclusion of all other conditions. Additional conditions of the Customer are excluded, unless they have been accepted by Broodjesbrigade in writing and expressly in advance.

Price

All prices stated are in EURO, always excluding VAT (unless otherwise stated). During the online checkout process, 6% VAT and any delivery costs (depending on the delivery address) will be charged. More information about delivery costs.

The stated price applies exclusively to the items as described verbatim. The accompanying photos are for decorative purposes only and may contain elements that are not included in the price.

Offer

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer are not binding on Broodjesbrigade. Broodjesbrigade is only obliged to a best-efforts obligation with regard to the accuracy and completeness of the information offered.

If the Customer has specific questions about, for example, sizes, colours, availability, delivery time or delivery method, we ask the Customer to contact us in advance at info@broodjesbrigade.be or 0498 971 467.

The offer is always valid as long as stocks last and can be adjusted or withdrawn by Broodjesbrigade at any time. Broodjesbrigade cannot be held liable for the unavailability of a product. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.

Online purchase process

During the online ordering process, the Customer can add various products to their shopping basket. Specific product options are offered per product, which are selected at the time of adding to the shopping basket. Afterwards, the Customer can still remove products or change quantities in the shopping basket, but the specific product options can no longer be adjusted there. Once the shopping basket is complete, the Customer can proceed to checkout.

The Customer can choose from the following payment methods:

  • by debit card
  • by credit card
  • cash
  • by bank transfer (for professional customers paying by invoice only)

Broodjesbrigade is entitled to refuse an order due to a serious shortcoming on the part of the Customer concerning orders in which the Customer is involved.

Delivery and execution of the agreement

Items ordered via this webshop are delivered in Belgium provided that the Customer's postcode is part of the active delivery zones. If this is not the case, the Customer will only have the option to collect the products or can contact Broodjesbrigade to discuss what is feasible.

Delivery is carried out by our own drivers.

Unless otherwise agreed or explicitly stated, goods are delivered to the Customer's home on the day they have chosen during checkout. We also try to take the preferred delivery time into account as best as possible.

Any visible damage and/or qualitative defect of an item or other delivery defect must be reported to Broodjesbrigade by the Customer without delay.

Right of withdrawal

The Customer cannot exercise the right of withdrawal for:

  • the delivery of goods that are liable to spoil or have a short shelf life;
  • service agreements after the service has been fully performed (if performance has begun with the express prior consent of the Customer, and provided the Customer has acknowledged that they lose their right of withdrawal once the agreement has been fully performed);
  • the delivery of alcoholic beverages where the price has been agreed upon at the conclusion of the sales contract, but the delivery can only take place after 30 days, and the actual value depends on market fluctuations beyond the control of the company;

Warranty

Under the law of 21 September 2004 on the protection of consumers in respect of the sale of consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner.

To claim the warranty, the Customer must be able to present proof of purchase. If a defect is found, the Customer must inform Broodjesbrigade as soon as possible. In any event, any defect must be reported within a period of 2 months after its discovery by the Customer. After this, any right to repair or replacement will lapse.

The warranty does not apply to items with a shorter lifespan or items with a shorter expiry date, such as food. The warranty never applies to defects caused by accidents, neglect, falls, use of the item contrary to its intended purpose, failure to comply with the instructions for use or manual, modifications or alterations to the item, rough handling, poor maintenance, or any other abnormal or incorrect use. Defects that manifest themselves after a period of 6 months following the date of purchase, or delivery if applicable, are presumed not to be hidden defects, unless proven otherwise by the Customer.
